GENERAL CONDITIONS

(pursuant to Chapter i, Title 3, Part 3 of Legislative Decree 206/2005 and subsequent amendments and supplements)

1. Introduction and effectiveness of the General Conditions
The purpose of these general conditions of sale (hereinafter, "General Conditions") is to regulate the purchase of products and services, carried out remotely and made available, via the internet, from the site www.casagin.com (hereinafter, the "Site") in accordance with Italian law as per Legislative Decree 206/2005 and subsequent amendments and supplements (hereinafter, "Consumer Code").
The seller of the products and owner of the Site is: Civico9 s.r.l.s. with registered office in via Matteotti 2/a, 35020 Sant'Angelo di Piove di Sacco, Padova. C.F/ P.I. and registration with the Companies' Register of Padua no. 05059094283, REA PD - 439810 - E-mail address: info@casagin.com (hereinafter the "Company").
When you access the Site to make purchases, you are obliged, before sending your order, to read carefully these General Conditions which have been made available to you on the Site and which you can consult at any time, including via the link contained in the email confirming each order, so that they can be reproduced and memorised . Please note that any purchase on the Site implies automatic acceptance of all the General Conditions.
These General Conditions may be subject to changes and updates. In the event of changes to the General Conditions, the General Conditions published on the Site at the time you place your order will apply.
In this regard, we invite you to read these General Conditions carefully before making any purchase and to print them out or keep them for your own reference.
If you decide to make purchases on the Website requesting the issuance of an invoice and/or you are not a "consumer or user" as defined in Article 3, paragraph 1, letter a) of the Consumer Code, the withdrawal rules set out in Articles 7 and 8 of these General Conditions or, more generally, the provisions of the Consumer Code that apply only to "consumers" shall not apply.
Contracts concluded with the Company through the Site are governed by these General Conditions in accordance with Italian law. The language available to conclude the contract is Italian.

2. Choosing and ordering Products
The characteristics and price of the various products for sale on the Website (hereinafter the "Product" or "Products") are shown on the page relating to each Product.

To purchase Products, you must fill in and send the electronic order form, following the instructions on the Website. You will have to add the Product to the "Shopping Cart" and, after having read the General Conditions and Privacy Policy and confirmed their acceptance, you will have to enter the shipping and billing information, select the desired payment method and confirm the order.
By sending the order from the Site, which constitutes a contractual proposal, you acknowledge and declare that you have read all the information provided to you during the purchase process and that you accept these General Terms and Conditions and the payment terms in full.
The contract of sale concluded between you and the Company shall be deemed to be concluded upon acceptance of the order by the Company. This acceptance will be communicated to you by means of an email confirming the order itself and containing a reference to these General Conditions, the order number, the shipping and possible billing information, the list of Products ordered with their essential characteristics and the total price, including any delivery charges. You are required to check the confirmation email and if you find any errors in the order you will have 24 hours from receipt of this email to contact the Company's Customer Service at info@casagin.com. After this time, the order will be processed for shipment and no further changes will be accepted, without prejudice to your rights under Article 7 below.
The Company reserves the right to assess the acceptance of orders received and may refuse or in any case not process purchase orders that are incomplete or incorrect. In this case, the Company will inform you of the impossibility of accepting the orders received within 48 hours from the working day following that on which you sent the order and will refund any sums you have already paid for the supply.

3. Information on the Products
The information and characteristics relating to the Products are available on the Site.
Each Product is guaranteed against possible manufacturing defects.
The visual representation of the Products on the Site normally corresponds to the photographic image accompanying the description sheet. It is understood that the image of the Products has the sole purpose of presenting them for sale; there may therefore be small differences between the graphic/photographic representation of the Product and the real Product. The photographs of the Product presented on the Site do not therefore constitute a contractual element as they are merely representative of the Product sold.

4. Prices and shipping
The prices of the Products are inclusive of VAT applicable by law. All prices are expressed in Euro.

Shipping in Italy: In all Italy, shipping is free for orders over 50€, otherwise at the fixed price of 8€.
Shipping Abroad: The cost of shipping abroad is at the fixed price of 15€ in Europe and at the fixed cost of 35€ in the rest of the world.
The prices of the Products published on the Site may vary; the Company reserves the right to make changes without prior notice.
The price shown on the Website at the time the order is placed applies to the Products, without taking into account any previous offers or any price changes that may have occurred subsequently.
In the event that a price has been incorrectly published by mistake, the Company reserves the right not to confirm the order received, waiving the sale.
Should the Products ordered be delivered outside the European Community, you may be subject to import duties and taxes, payable once the package reaches its specified destination. Any additional customs clearance costs will be borne by you. We have no control over these costs and cannot predict the amount, as customs policies vary from country to country, so please contact your local customs office for further information. Please also note that when you place an order on the Website, you are considered an importer and are therefore required to comply with all laws and regulations of the country in which you will receive the Products; you should also be aware that cross-border deliveries are subject to opening and inspection of the Products by customs authorities.

5. Methods of payment and invoicing
5.1 Payment methods
You may pay the price of the Products and the relevant delivery costs by Stripe, PayPal, credit card and bank transfer.
PayPal
Once the order has been confirmed, you will be redirected to the PayPal website where you can pay using your account or a card, even a prepaid card, or in any case according to the methods accepted by PayPal and in compliance with the relative conditions.
Bank transfer
If you pay by bank transfer, the Products will be shipped after verifying that the credit has been credited to the Company's current account.
The reason for payment on the bank transfer must contain the following data: the name and surname of the payer and the order number.
In the current state of the banking system, the amount transferred is credited to the beneficiary's current account no earlier than 3/5 working days from the date of the transfer.
If the company does not receive payment within 5 working days of the order being placed, the order shall be cancelled.
5.2 Invoicing of orders
The Company will issue, if requested, the invoice for the purchase of the Products.

You can request the issuance of the invoice by writing an email to customerservice@casagin.it, indicating the order number and entering your billing information including your tax code and/or VAT number.
You are responsible for the correct insertion of the invoicing data and you are expressly informed that, if you do not request the invoice during the order process, it will not be possible to request it later.
The invoice shall be issued on the basis of the information provided by you and no changes to the data will be possible after the invoice has been issued.

6. Transport and delivery
The Products purchased on the Site will be delivered to the address indicated during the purchase procedure in the order form.

The Products will be shipped only after the Company has received the full amount of the order (including the price of the Products purchased, VAT and any other taxes and duties and shipping costs, if due).
All purchases will be delivered to you by express courier (hereinafter, "Courier") from Monday to Friday, excluding public holidays and national holidays. The Company is not responsible for delays that cannot be foreseen or attributed to it caused by the Courier.
Once the Products have been dispatched, you will receive a confirmation email indicating the tracking number to track the delivery of your order.
Products shipped in Italy are approximately delivered within 2-5 working days from shipment and those shipped within the European Union within 6-7 working days from shipment. In any case, the delivery terms indicated above are purely indicative and not essential. Any variation to the above will be promptly communicated to you by e-mail. The Company accepts no responsibility for any delays in delivery caused by the Courier.

At the time of delivery, your presence or that of a representative or person you trust is required to check that - the packaging is intact, undamaged, not wet or in any case conforms to the standard characteristics of the same; - the number of packages received corresponds to that indicated on the order confirmation. Any complaints regarding the non-integrity of the packages and their number must be raised immediately with the carrier; failing this, the Products shall be considered correctly delivered.
If, on delivery of the Products, there is evident damage to the packaging, you will still be required to accept the goods and if, apart from the external packaging, you actually find damage to the goods, within 14 working days, contact the carrier's call centre (02 30 30 39) reporting the damage and keeping the original packaging (it is important to keep the original packaging otherwise the carrier's warranty will be void) . Once the damage file has been opened, a forwarding agent will contact you to inspect and verify everything.

In any case, the guarantees provided for by Directive 1999/44/EC and subsequent amendments and additions are not affected.
If no one is present at the time of delivery, the Courier shall deliver the parcel to the nearest collection point.

The courier will leave a notice of attempted delivery in the mailbox, or in the email box entered by the customer at the time of purchase, if the customer enters the telephone number when ordering, the courier can use it to reschedule the delivery or provide all the necessary information and indications on the collection point.

To collect your order at the collection point, you will need to present a valid identity document. If you are unable to collect your parcel in person, you may delegate another person to collect it. This person must have with them: a letter of proxy; their own valid identity document; a copy of your valid identity document.

If the package is not collected from the courier's collection point within 10 days, it will be sent back to the Company's warehouse, which will refund the customer minus the shipping costs necessary for the return and the storage costs of € 1.00 per day.

If the package is not delivered due to the customer entering the wrong address at the time of purchase, it will be sent back to the Company's warehouse, which will refund the customer minus the shipping costs necessary for the return and the storage costs of € 1.00 per day.

If the customer wishes to request an additional shipment, he will be charged for the cost of returning the previous shipment and for redelivery.

7. Diritto di recesso
7.1 Diritto di recesso
Lei ha il diritto di recedere dal contratto, senza indicarne le ragioni, entro 14 giorni. Il periodo di recesso scade dopo 14 giorni dal giorno in cui Lei o un terzo, diverso dal vettore e da Lei designato, acquisisce il possesso fisico dei beni.
Per esercitare il diritto di recesso, Lei è tenuto a informarci al seguente indirizzo email customerservice@casagin.it o al seguente indirizzo: CASAGiN, Via Umberto I° n. 134/6, 35020 Casalserugo (PD), della sua decisione di recedere dal presente contratto tramite una dichiarazione esplicita (ad esempio lettera inviata per posta, fax o posta elettronica). Per rispettare il termine di recesso, è sufficiente che Lei invii la comunicazione relativa all’esercizio del diritto di recesso prima della scadenza del periodo di recesso. Può scaricare questo modulo, compilarlo e inviarcelo secondo le opzioni riportate qui sopra.

7.2 Effetti del recesso
Se Lei recede dal presente contratto, Le saranno rimborsati tutti i pagamenti che ha effettuato a nostro favore, compresi i costi di consegna (ad eccezione dei costi supplementari derivanti dalla Sua eventuale scelta di un tipo di consegna diverso dal tipo meno costoso di consegna standard da noi offerto), senza indebito ritardo e in ogni caso non oltre 14 giorni dal giorno in cui siamo informati della Sua decisione di recedere dal presente contratto. Il rimborso potrebbe essere trattenuto oltre i 14 giorni solo finché Lei non abbia dimostrato di aver rispedito i beni o finché questi non siano stati da noi ricevuti, a seconda di quale situazione si verifichi prima.

Detti rimborsi saranno effettuati utilizzando lo stesso mezzo di pagamento da Lei usato per la transazione iniziale, salvo che Lei non abbia espressamente convenuto altrimenti; in ogni caso, non dovrà sostenere alcun costo quale conseguenza di tale rimborso. Il rimborso può essere sospeso fino al ricevimento dei beni oppure fino all’avvenuta dimostrazione da parte del consumatore di aver rispedito i beni, se precedente. E’ pregato di rispedire i beni o di consegnarli a noi al seguente indirizzo (CASAGiN, Via Umberto I° n. 134/6, 35020 Casalserugo (PD)) senza indebiti ritardi e in ogni caso entro 14 giorni dal giorno in cui ci ha comunicato il suo recesso dal presente contratto. Il termine è rispettato se Lei rispedisce i beni prima della scadenza del periodo di 14 giorni. I costi diretti della restituzione dei beni saranno a Suo carico.
Lei è responsabile solo della diminuzione del valore dei beni risultante da una manipolazione del bene diversa da quella necessaria per stabilire la natura, le caratteristiche e il funzionamento dei beni.
7.3 Tempistiche di recesso
Ai sensi dell’art. 52 del Codice del Consumo, il Consumatore può recedere dal contratto entro 14 giorni decorrenti dalla ricezione della merce o, in caso di consegna di un bene costituito da lotti o pezzi multipli, dal giorno in cui il Consumatore o un terzo, diverso dal vettore e designato dal Consumatore, acquisisce il possesso fisico dell’ultimo lotto o pezzi.

7.4 Modalità per esercitare il recesso
Per esercitare il diritto di recesso, Lei è tenuto a informarci della sua decisione di recedere dal presente contratto tramite una dichiarazione esplicita (ad esempio lettera inviata per posta, fax o posta elettronica). Può utilizzare il seguente modulo a sua disposizione e contattarci ai seguenti indirizzi email: customerservice@casagin.it.

7.5 Esclusioni al recesso
Il diritto di recesso è escluso nei seguenti casi previsti dall’art.59 del Codice del Consumo:

e) la fornitura di beni sigillati che non si prestano ad essere restituiti per motivi igienici o connessi alla protezione della salute e sono stati aperti dopo la consegna;
7.6 Tempistiche di reso
E’ pregato di rispedire i beni o di consegnarli a noi senza indebiti ritardi e in ogni caso entro 14 giorni dal giorno in cui ci ha comunicato il suo recesso dal presente contratto. Il termine è rispettato se Lei rispedisce i beni prima della scadenza del periodo di 14 giorni.

7.7 Rimborso
Se Lei recede dal presente contratto, Le saranno rimborsati tutti i pagamenti che ha effettuato a nostro favore, compresi i costi di consegna (ad eccezione dei costi supplementari derivanti dalla Sua eventuale scelta di un tipo di consegna diverso dal tipo meno costoso di consegna standard da noi offerto), senza indebito ritardo e in ogni caso non oltre 14 giorni dal giorno in cui siamo informati della Sua decisione di recedere dal presente contratto. Il rimborso potrebbe essere trattenuto oltre i 14 giorni solo finché Lei non abbia dimostrato di aver rispedito i beni o finché questi non siano stati da noi ricevuti, a seconda di quale situazione si verifichi prima.

Il diritto di recesso viene meno nel caso in cui la Società dovesse accertare, una volta ricevuto il Prodotto oggetto di restituzione, che lo stesso sia stato danneggiato e/o che lo stesso sia non integro. In questo caso la Società provvederà ad avvisarti tempestivamente e a restituirti il Prodotto, addebitandoti le spese di spedizione ed il relativo costo.
Tutti i prodotti restituiti saranno controllati dalla Società entro 48 ore dalla ricezione del pacco. Al cliente verrà inviata una e-mail di conferma dell’accettazione dei prodotti restituiti e del rimborso dovuto. Nel caso di un reso fosse respinto, il nostro servizio clienti spiegherà la ragione del rifiuto e il pacco sarà restituito al cliente addebitandoti le spese di spedizione ed il relativo costo.
7.8 Ritiro
Il costo diretto della restituzione dei beni sara’ a Suo carico.

7.9 Diminuzione del valore
Lei è responsabile solo della diminuzione del valore dei beni risultante da una manipolazione del bene diversa da quella necessaria per stabilire la natura, le caratteristiche e il funzionamento dei beni.

8. Guarantee
All products are subject to the legal guarantee of conformity provided for by the Consumer Code in articles 128 et seq. The warranty has a total duration of two years, starting from the time of delivery of the goods. The consumer must notify the defect within two months of its discovery.

9. Errors and limitations of liability
The information relating to the Products provided through the Site is constantly updated. However, it is not possible to guarantee the absence of errors for which, therefore, the Company cannot be held responsible, except in the case of fraud or gross negligence.
The Company reserves the right to correct errors, inaccuracies and/or omissions even after an order has been placed, or to modify and/or update the information at any time without prior notice, without prejudice to your rights under these General Conditions and the Consumer Code. In the absence of wilful misconduct or gross negligence, your right to compensation for damages or recognition of an indemnity is excluded, as well as any contractual or extra-contractual liability for direct or indirect damages to persons and/or things, caused by the non-acceptance or non-fulfilment, even partial, of an order.

11. Online consumer dispute resolution (ODR)

12. Applicable law and competent court
The sales contract between the Customer and the Company is governed by Italian law.
All disputes relating to and/or connected to this sales contract shall be the exclusive competence of the Court of Padua.
Disputes with consumer Customers are devolved to the competence of the Judicial Authority of the place of residence or domicile of the consumer Customer.
Disputes with consumer Customers residing outside the Italian territory are under the competence of the Court of Padova, as the judge of the place where the Contract is executed.

13. Approval of the clauses
The Customer declares that he/she is aware of the exact content of all the clauses of the contract, that he/she has freely, fully and specifically approved them individually and as a whole.
